Gift in your Will – Wording

You should always talk through your wishes for your Will and any Gift Legacy to Charity with your solicitor who will be able to advise on the correct format for inclusion and appropriate wording.  We have put together some sample wording for you which you will find below to give you an idea of the type of amendments or wording that could be used.

Always ensure that you seek professional legal advice in relation to any Will you have written and in particular any Gifts to Charity or Legacies you include.

There are 3 types of Gift that you can leave in your Will.  We have listed these below along with sample wording that could be used to include a Gift in your Will to Sunny Harbour Cat Rescue.  The sample wording given below relates to including your gift to charity in your Will at the time of writing your Will.

If you already have a Will in place then you will need to add a Codicil which we discuss further down this page.

Residuary Gift (sometimes referred to as a Residuary Legacy)

This is where you provide a gift of a proportion or the remainder of your estate after all other gifts have been allocated to their recipients and all costs have been paid.

Suggested Wording:

I leave to Sunny Harbour Cat Rescue of 70 Bank Street, Lochgelly, Fife, KY5 9QN Charity Registration Number SC041871 (% proportion of residue to be entered here) for its general purposes and I direct that the receipt of the duly authorised officer shall be sufficient discharge to my executors.

Pecuniary Gift (sometimes referred to as a Pecuniary Legacy)

This is where you specify an exact amount of money you wish to be given to a particular charity.

Suggested Wording:

I leave to Sunny Harbour Cat Rescue of 70 Bank Street, Lochgelly, Fife, KY5 9QN Charity Registration Number SC041871 the sum of £(enter value here) for its general purposes and I direct that the receipt of the duly authorised officer shall be sufficient discharge to my executors.

Specific Gift  (sometimes referred to as a Specific Legacy)

This is where you include in your will that a particular item is to be gifted to your chosen charity i.e. a valuable painting or collection.

Suggested Wording:

I leave to Sunny Harbour Cat Rescue of 70 Bank Street, Lochgelly, Fife, KY5 9QN Charity Registration Number SC041871 (description of item to be gifted) absolutely for the general purposes of the said charity and I direct that the receipt of the duly authorised officer shall be sufficient discharge for my executors.

Adding a Codicil to include your Gift to Charity in your Will

A codicil is used when you wish to add information to your existing Will.  In this example wording, in relation to leaving a lasting legacy in the form of a Gift in your Will to Sunny Harbour Cat Rescue.  As with the sample wording above we would always recommend that you seek professional legal advice to ensure that all necessary steps are taken to add the codicil to your existing Will and that all wording is accurate and without interpretation.   Other information and witnessed signatures are required for a codicil and so we would recommend that you have a solicitor draw up the codicil for you.

Suggested Wording for the Gift in your Will:

I, (enter your Full Name) of (enter your Full Address) declare this to be a (first/second etc) codicil to my Will dated (enter date).

In addition to any legacies given in my said Will I give to Sunny Harbour Cat Rescue, 70 Bank Street, Lochgelly, Fife, KY5 9QN SC041871 a (value) % share of my estate, the sum of £ (enter value), or a gift of a specific item (enter item description) to be used for its general purposes and I declare that the receipt of the duly authorised officer shall be sufficient discharge for my executors.

In all other respects I confirm my said Will and any other existing codicils.

Once signed and witnessed you should store a copy of your Codicil with all copies of your current Will including any held by your solicitor.
